From in-space manufacturing and assembly (ISAM) to privately run space stations and missions to Mars, we’re entering a new era of space innovation, with the United States under pressure to take an international leadership role. The growth of these novel space activities increases the burden on the Federal Communications Commission to manage the needs of industry. Meanwhile, a conservative supermajority on the Supreme Court and new House majority leadership signal skepticism of broad agency interpretations of authority. FCC Chairwoman Rosenworcel has responded by proposing the creation of a new Space Bureau and initiating several “Space Innovation” proceedings aimed at streamlining the processing of licenses. Meanwhile, Congress is considering the Satellite and Telecommunications Streamlining Act, which would require more responsive timelines for FCC action. In short, the regulatory regime that many in the space industry know and understand is in a state of flux, with the final disposition unknown.
